Legal services for Narre Warren South, Hampton Park and Lynbrook clients
Narre Warren South and Lynbrook grew from the 1990s, filling the gap between the Berwick and Cranbourne corridors, with Lynbrook and Merinda Park stations on the Cranbourne line. Hampton Park is older: its estate was offered in lots for poultry farms and market gardens after World War I, and it grew into a residential suburb through the 1980s and 1990s. Lyndhurst, which is shared with Greater Dandenong, takes its name from Baron Lyndhurst, three times Lord Chancellor of England.
Most homes here are separate houses, and at the 2021 Census more than half of those in Narre Warren South and Lynbrook were owned with a mortgage. We act for buyers and sellers, for families making wills or dealing with an estate, and for couples who are separating. Radek Dajer, our principal solicitor, acts personally on each matter, in English or in Polish, and we meet at our Frankston office or by video.
Local note
The Hampton Park Central Development Plan, adopted by the council in June 2026, plans for a greater diversity of housing in Hampton Park’s town centre.

Established homes in estates built from the 1980s to the 2010s, and townhouses and units.
- Before you sign: we check the contract, the section 32 statement and the planning controls on the land, including any overlay, and suggest changes while you can still negotiate.
- Cooling-off: for many private sales of residential property, you have 3 clear business days after signing to end the contract. There is none at a publicly advertised auction.
- Selling: most sellers now need an Australian Taxation Office clearance certificate by settlement, whatever the price. Apply early, because it can take some weeks to issue.
- First home buyers: pay no land transfer duty on homes up to $600,000 and reduced duty up to $750,000. A $10,000 first home owner grant may apply to a new home valued at $750,000 or less.
Wills, powers of attorney and estates for long-term owners and young families.
- Wills: executors, gifts, guardians for young children and testamentary trusts, including for blended families.
- Enduring power of attorney: appoints someone to make financial or personal decisions for you, and continues if you lose capacity. Made under the Powers of Attorney Act 2014 (Vic).
- Executors: probate and administering the estate. Probate applications are filed online with the Supreme Court of Victoria.
- Family provision claims: must generally be filed within 6 months after the grant of probate or letters of administration.
Separation, property settlement and parenting arrangements, where the family home and its mortgage are often the main asset.
- Separation and divorce: are separate legal steps under the Family Law Act 1975 (Cth). You do not need to be divorced to settle property or parenting arrangements, and a divorce does not settle them for you.
- Time limits: married couples must apply to the court within 12 months after their divorce takes effect, and de facto couples within 2 years after the relationship ends.
- Parenting: before applying for parenting orders you generally need a certificate from a family dispute resolution practitioner, unless an exception applies, such as family violence, child abuse or urgency.
- Courts: the Federal Circuit and Family Court of Australia has a registry at 53-55 Robinson Street, Dandenong.
Local plans that may matter to buyers and neighbours in Hampton Park.
- Hampton Park Central: the council adopted an updated development plan in June 2026, which plans for a greater diversity of housing in the town centre.
- 290 Hallam Road: in April 2026 VCAT upheld the EPA’s refusal of a development licence for a waste transfer station next to the Hallam Road landfill, so the council’s planning permit for it cannot be acted on.
- Objections: Objector appeals and appeals about permit conditions in Casey are usually heard at VCAT Frankston, near our office.
Selling a parent’s home?
If the home was in a late parent’s sole name, the executor usually needs a grant of probate before the sale can settle. We can run the probate application and the sale together.

Common questions
Can’t see your question? Call 1800 776 529 or send us a message.
Both. Lyndhurst is split between the City of Casey and the City of Greater Dandenong. Your rates notice or the planning property report shows which council your land is in, which matters for planning permits.
A Magistrates’ Court matter generally goes to the court closest to where it arose or where the other party lives, which for this area is usually Dandenong. Objector appeals and appeals about permit conditions in Casey are usually heard at VCAT Frankston, near our office.
If they made an enduring power of attorney, the attorney can act under it. If not, and they have lost capacity, an application to VCAT for an administration or guardianship order may be needed.
Yes, review it promptly. Separation alone does not revoke your will or a gift to your former partner. Divorce revokes gifts to a former spouse and their appointment as executor, but only once the divorce takes effect. Check your superannuation nominations too.
