  • Flood overlays: the Special Building Overlay and the Land Subject to Inundation Overlay generally require a planning permit for buildings and works. The flood risk is assessed by the floodplain authority, which is Melbourne Water or, for some sites, the council.
  • Refusals happen: in 6C RAZ Pty Ltd v Frankston CC [2024] VCAT 892, VCAT refused permits for a development in Carder Avenue, Seaford, in the Special Building Overlay, because of the flood risk.
  • Mapping under review: council, Melbourne Water and the state are updating flood and coastal hazard mapping across Frankston City, with draft maps due in 2027. The controls on your land may change.

  • Retail or not: the Retail Leases Act 2003 (Vic) covers many shops and service businesses. Offices, warehouses and factories are often outside it, and then the lease itself governs.

  • Make-good: the obligation to return the premises to a defined condition varies widely between leases, and the cost can be substantial.
  • Industrial precincts: since 27 February 2026, buildings and works of up to $3 million in the Seaford and Seaford North industrial precincts can generally use VicSmart, the 10 business day permit process.

  • Wills: executors, gifts, guardians for young children and testamentary trusts, including for blended families.

The planning property report for your address shows whether a Special Building Overlay or a Land Subject to Inundation Overlay applies. Melbourne Water can give flood information for a property. We check these controls as part of reviewing the contract, so ask us before you buy, build or extend.

Often not. The Act covers premises used wholly or mainly for the retail sale or hire of goods or the retail provision of services. Factories, warehouses and workshops are often outside it, and then the lease itself governs. Whether it applies is a question of fact and law.

Not unilaterally, unless the lease or the law gives you that right. The usual routes are a negotiated surrender, or an assignment of the lease to an incoming tenant, often on the sale of the business. Both require the landlord’s involvement.

If you are an eligible person, you may be able to make a family provision claim, which must generally be filed within 6 months after the grant of probate. A will can also be challenged if there are doubts about how it was made or signed. Get advice early, because the time limit is strict. See probate and estate administration.
